Section 64 of the ERA 2000 requires employers to keep a signed copy of an individual employment contract (or working conditions) provided to an employee (or potential employee), even if the employee has not signed or consented to it. The employee must receive a copy of the agreement when requested. If an employer fails to keep or provide a copy of the individual employment contract, a labour inspector may send him or her a notice within 7 days to comply. Otherwise, it may result in a penalty. An employment contract may contain all other conditions that employees and employers have agreed upon, para. B example the notice period, a regulation on the probation period, a determination of availability as to whether the employee can work on a public holiday or an annual closure. . . . .
